1. What This Notice Covers
This notice describes how Eclosion Health, PLLC ("Eclosion") maintains, uses, protects, and discloses your health information, and the rights you have regarding it.
Eclosion is a direct-pay practice. Your health information is protected under applicable Florida and federal law as described in this notice.
2. The Records We Keep
Eclosion maintains a medical record of your care, which may include your history, examination findings, ultrasound and other clinical images, procedure documentation, communications about your care, prescriptions, consents, and billing records.
Records generated during telehealth visits are maintained to the same standard as in-person care.
3. How We Use Your Information
Eclosion uses your health information to evaluate and treat you, document your care, communicate with you regarding your care, process payment for services, and conduct the ordinary administration of the practice.
Access is limited to people involved in your care or in appropriate practice administration.
4. When We Disclose Your Information
Eclosion does not sell your health information and does not use it for third-party marketing.
Your records may be disclosed:
- with your written authorization;
- to licensed health care practitioners and providers involved in your care and treatment;
- to vendors or service providers supporting Eclosion's records, technology, communications, billing, payment, security, legal, or administrative operations where permitted by law and subject to appropriate confidentiality safeguards;
- in response to lawful process as permitted by applicable law;
- to the Florida Department of Health, a licensing board, or another authority where an investigation or law requires it;
- in a medical emergency to the extent reasonably necessary for treatment; and
- where Florida or federal law otherwise requires or permits disclosure.
Allowing another person to be present during a visit does not by itself authorize Eclosion to release your medical records to that person.
5. Your Rights
You may inspect your records and receive copies of them. A reasonable copying charge, as permitted by Florida law, may apply.
You may direct that copies of your records be sent to another provider or person of your choosing through Eclosion's records-release process.
You may revoke an authorization you have given, in writing, except to the extent Eclosion has already acted on it.
You may tell Eclosion how you prefer to be contacted and ask that a contact method be limited or stopped where appropriate.
If you believe information in your medical record is inaccurate, you may ask Eclosion to review it. Any correction, clarification, or additional statement will be handled in accordance with applicable law and appropriate medical-record practices.
6. How We Protect Your Information
Eclosion uses reasonable administrative, technical, and physical safeguards appropriate to the information it maintains.
Electronic records, clinical images, devices, and temporary records are handled under Eclosion's information-security and records-management procedures to reduce the risk of unauthorized access, use, disclosure, loss, or alteration.
7. Retention and Disposal
Eclosion retains medical records for at least the period required by Florida law and securely disposes of records and devices containing health information when disposal is appropriate.
8. If a Breach Occurs
If a security breach affects personal information, Eclosion will investigate and provide notification as required by the Florida Information Protection Act and other applicable law.
9. Questions and Complaints
You may raise a privacy question or complaint with Eclosion at any time, and doing so will not affect your care.
You may also direct an appropriate complaint to the Florida Department of Health.
10. Changes to This Notice
Eclosion may revise this notice.
The version in effect will be identified by its effective date, and an updated notice will be made available when applicable.
